Terms of Use

Last updated: October 1, 2026

These Terms of Use (“Terms”) govern your access to and use of TekDot websites, apps, software, hardware support, and related services (the “Services”), operated by TekDot POS (“TekDot”, “we”, “us”, or “our”). By creating an account, signing an order or agreement, or using the Services, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.

Signed agreements come first. If you have a signed service or license agreement with TekDot (for example for installation, hardware, or custom work), that agreement governs where it covers a topic and prevails over these Terms if they conflict. These Terms apply to everything the agreement does not cover.

1. Who we are

TekDot is a restaurant and hospitality operations platform that may include POS, kitchen display, waiter apps, reservation tools, QR menus, inventory, reporting, owner apps, and related features. Our official website is www.tekdotpos.com, including the restaurant-specific URLs we provide under it (for example www.tekdotpos.com/yourrestaurant/). TekDot does not operate any other domain.

2. Eligibility & accounts

3. Plans, trials & fees

TekDot offers plans such as Stall, Starter, Professional, Enterprise, trials, and one-time buyouts. Pricing, features, deployment type (cloud-only or cloud + local server), and limits are described on our website or in your quotation.

4. Late payment & suspension

If fees are not paid by the due date, we will send a reminder. If an amount remains unpaid after the reminder period (14 days unless your agreement says otherwise), we may suspend access to the Services until payment is received. Suspension limits access only — it does not delete your data, and read-only access or export may remain available as described in Section 9. Access is restored after we confirm payment.

5. Customization & additional services

6. Hardware

Hardware supplied by TekDot is covered by the warranty stated in your quotation or agreement, which covers manufacturing defects and ordinary use. The warranty does not cover misuse, negligence, unauthorized repair or modification, liquid or physical damage, power surges, improper storage, or use other than as intended. Chargeable repairs are quoted before work starts. Rented or loaned hardware remains TekDot property and must be returned in good condition when the service ends; purchased hardware becomes yours once fully paid.

7. Support, updates & availability

8. Your responsibilities

You are responsible for:

Our support and recovery commitments do not apply to problems caused by any of the above.

9. Your data

How we handle personal data is explained in our Privacy Policy.

10. Acceptable use

You agree not to:

11. Intellectual property

TekDot software, source code, designs, custom features we build (including Customizations you paid for), branding, logos, UI, and documentation are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Services, including paid Customizations, solely for your own business operations while your subscription or license is active. Transferring your license to a new owner of your business requires our written consent, which we will not unreasonably withhold. Feedback and suggestions you give us may be used freely to improve TekDot.

12. Confidentiality

Each party will keep the other’s non-public business, technical, and financial information confidential and use it only for the purpose of the Services. This includes TekDot’s pricing, software, and documentation, and your business data. This obligation survives the end of your account.

13. Third-party services

The Services may integrate with third parties (payment providers, printers, messaging, maps, CDNs, email). Those services are subject to their own terms. TekDot is not responsible for third-party outages, fees, or policies.

14. Communications & references

By submitting forms or creating an account, you consent to us contacting you about your request, account, billing, service notices, and support. Marketing messages, where required, respect applicable opt-out rules. We may list your business name and logo as a TekDot customer on our website and marketing materials. You can ask us to stop at any time by emailing [email protected].

15. Cookies & location

Our use of cookies and similar technologies is described in our Cookie Policy. Location is only used where your browser grants permission, as described there and in our Privacy Policy.

16. Term, cancellation & termination

17. Disclaimers

EXCEPT AS EXPRESSLY STATED IN A SIGNED AGREEMENT, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be error-free, uninterrupted, or meet every operational requirement of your venue.

18. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss, including loss of profits, revenue, sales, data, goodwill, or business opportunity. TekDot’s total liability for all claims relating to the Services is limited to the fees you paid to us for the Services in the three (3) months before the event giving rise to the claim, or USD $100 if no fees were paid, unless a signed agreement sets a different limit. These limits do not apply to fraud, wilful misconduct, or liability that cannot be limited by law, or to your obligation to pay fees.

19. Indemnity

You agree to defend and indemnify TekDot against claims, fines, and costs arising from your misuse of the Services, your tax or legal compliance, your restaurant’s guest and staff data practices, content you upload, or your breach of these Terms.

20. Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, fire, flood, epidemic, war, civil unrest, government action, and failure of public power, internet, telecommunications, cloud, or payment networks.

21. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes will be communicated via the website, email, or in-product notice at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms.
